The retrial before before US District Judge Lucy Koh in San Jose, California, isn't about whether the South Korean company infringed its rival's patents - jurors will be told Apple has won on that count. The design patents that Samsung infringed concern the physical shape that would become the iPhone, the bezel, and the colorful grid of icons.

It will be the third time that the five patents have been put under the microscope since the dispute began.

John Quinn, a founding partner of Quinn Emanuel Urquhart & Sullivan who is representing Samsung alongside firm partners William Price and Victoria Maroulis, countered Lee's argument in his opening statements, arguing that Apple should receive the total phone profits.

Apple lawyer Bill Lee told jurors this week that their sole goal was to determine what damages the company should collect. The first jury had awarded damages based on those patents and on trade dress for 13 Samsung models, necessitating a recalculation of damages for the utility patent infringement only.

Apple, on the other hand, asserts the article of manufacture is the entire phone.

The U.S. Supreme Court, which took up the Apple-Samsung patent fight in 2016 after a series of appeals, ruled on a narrow aspect of the case by finding juries and judges can look at discrete articles of manufacture, or components of a product, when assessing damages. Come December 2015, it was decided that Samsung would finally pay Apple $548 million.

The Patent Act awards all profits from sales of any "article of manufacture" that infringes a patented design. A new jury will make that decision for three such design patents, including one covering the rectangular shape, rounded corners and black glass of the iPhone's front face.

Apple and Samsung are now fighting it out again.

Had Apple not released the iPhone, it anxious that mobile carriers could easily make the iPod obsolete by adding music to their phones, which served as a "gigantic threat" to the company and its mainstay media player. Those testimonies brought some insight into the iPhone design process and more. If Samsung comes out on top, it will still need to pay Apple but not at as big of a cost.
