In its 17-page complaint, the federal government is relying on the U.S. Constitution's Supremacy Clause, as well as the lesser known Property Clause ("Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States") to prevent the burdening of federal land sale plans with Californian red-tape.

The Department of Justice sued California Monday over a law that allows the state to block any federal land transfer with in the state.

The lawsuit seeks an injunction against California Senate Bill 50, which requires the federal government to give the state's land commission the option to buy federal land before it can be transferred to another owner because the Justice Department claims it is unconstitutional.
