"He thereafter deliberately and repeatedly lied", as well as "withheld and otherwise destroyed documents requested by the Special Counsel's Office through his counsel relating to his work with Manafort, Gates, and Person A" including a September 12, 2016, email "that the government had obtained through other means".

A former Russian intelligence officer who worked with U.S. President Donald Trump's former top campaign officials Paul Manafort and Rick Gates was communicating with Gates late in the 2016 presidential campaign, according to court records filed by Special Counsel Robert Mueller's office. According to the sentencing motion filed Tuesday, van der Zwaan's lies "were material" to the special counsel's investigation, and directly involved communications with Gates and "Person A", a former GRU officer.

He also says he's anxious he'll miss the birth of his first child, which is due in August. (GRU is Russia's military intelligence organization.) So according to van der Zwaan, Gates talked openly about Person A's ties to Russian intelligence. Van der Zwaan had recorded those calls, but in his first meeting with investigators, represented by a Skadden partner, he failed to tell investigators about the recordings, according to the filings. He lives alone in a hotel in a city where he has no close friends.

Prosecutors wrote that van der Zwaan "presents a scarcity of mitigating factors, and several aggravating circumstances", including the extent of his false statements to investigators.

Sentencing guidelines suggest 0 to 6 months in prison. He also faces a fine of up to $250,000.

The case is U.S. v. van der Zwaan, 18-cr-00031, U.S. District Court, District of Columbia (Washington). Facing backlash over the political motivation of the charges - for which she was exonerated years later - Yanukovych's government asked Skadden, Arps, Slate, Meagher & Flom to compile a report in 2012 that said politics did not have an effect on the prosecution. He didn't produce an email that referred to the 2016 communications, as well as emails that would have revealed he was exploring options for leaving Skadden to work with Manafort and Gates. Afraid of the situation, the young attorney recorded a phone call with Gates and the unnamed Eastern European associate, and a call with his firm.

"The conduct that brings Alex before this Court was inexcusable", the filing says. "In his mind, his boss was listening to every word".

The special counsel's office countered that van der Zwaan's decision to come clean to Skadden about recordings he made using firm equipment were not "mitigating factors".

Van der Zwaan's plea deal did not include a cooperation requirement, though, and his lawyer asked for a sentencing date as soon as possible so that he can return to London to join his wife, who is pregnant.

Update: And of course, the biggest issue here is that Gates himself admitted to van der Zwaan that he knew of Kilimnik's relationships with Russian intel at the time.

New court documents filed Tuesday night directly connect Rick Gates, a former Trump campaign deputy chairman, to an operative with ties to Russia's military intelligence unit.

Van der Zwaan's criminal charge has no apparent connection to the Trump campaign aside from his contact with then-campaign aide Gates in 2016. He is cooperating with Mueller's office.

Van der Zwaan then chose to "correct the record", and went back for another meeting with the special counsel's office on December 1.

Manafort has acknowledged staying in frequent contact with Kilimnik during the time he worked for Trump's campaign, including meeting with him in person in May 2016 and again in August 2016, about two weeks before Manafort resigned as Trump's campaign chairman.

According to his sentencing memorandum, van der Zwaan first met with the special counsel's office on November 3.
